Definitions of words used in your agreement;
 
"We", "Ourselves", "Our", "GDC", “Provider” - means Grand Dining Club cc
"Member(s)", "You(r)", being the person that pays for the Grand Dining Club Membership.
 
“the User”- any one accessing the website www.grand-dining.co.za
 
"Membership period" - The period in which you are entitled to GDC membership and services. This is shown on your welcome letter/email/online application form. It also includes any further period, which you may pay for or agree to pay for and for which GDC agree to accept your application.
 
"Site", "website"- means www.grand-dining.co.za

"fees"- The amount payable by you for your membership as set out in your welcome letter/email/online application form.
 
"start date"- The date confirmed to you that your membership starts as shown in your welcome letter/email/online application form.
 
"trial period"- If you are entitled to a trial period, this will be confirmed in your welcome letter/email/online application form as your trial period.
 
"membership card"- a card that details your membership, including an expiry date, membership number, and name of member.
 
"service"- the GDC will provide you the opportunity to access discounts in a selection of restaurants
 
"your agreement"- Your welcome letter/email and these GDC Terms and Conditions.
 
welcome letter/email/online application form - The welcome letter/email/online application form containing important details including details of your fees and of the card, bank or other account which will be debited and forms a part of your agreement.
 
These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Grand Dining Club cc (“Provider”) website located at the domain name www.grand-dining.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.
 
You must read, agree and accept all of the terms and conditions expressly set out below and those incorporated by reference before you may become a member.

  1. All membership cards, remain the property of Grand Dining Club at all times. All information provided is correct at the time of publication. However, no liability is offered for errors contained herein, or the actions of 3rd parties.
     
  2. Special offers advertised on the Site are only available to our Members who following the indicated booking procedure and present their membership card on arrival at the restaurant and when requesting the bill. The 2-for-1 offer only applies to starters, mains and desserts (excludes side order and take aways). The discounts is not available in conjunction with any other offers the restaurant may be running at any one time - this may include set menus or any other menus other than the standard a la carte menu.
     
  3. We will use all reasonable endeavours to update the website to show the current particulars of participating restaurants and the terms of their availability for participation in the scheme. Participating restaurants may, however, be entitled to withdraw from the scheme or to change the terms and conditions of their availability after You have become a member and We shall have no responsibility for any such withdrawals by participating restaurants or any such changes in their terms and conditions or availability. Members will have the benefit of any additional restaurants which join Grand Dining Club after their membership commences and any increase in availability of participating restaurants. Any of Our printed marketing material which is printed, is intended as a guide of restaurants who are participating at the time of publication and therefore may not include all participating restaurants at any one time.
     
  4. The information contained in the material in our website is only for information purposes. We do not make any warranty or representation as to the accuracy or fitness for purpose of any material on this Site or the reliability of the access to this Site. Neither Ourselves nor any of Our directors, officers, agents, employees or other representatives will be liable for damages arising out of or in connection with the use of our Site or our services. This is a comprehensive limitation of liability that applies to all damages of any kind, including without limitation compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
     
  5. In no event do We accept liability of any description, including liability for negligence for any damages or losses including, without limitation, loss of business, revenue, profits, or consequential loss whatsoever resulting from use of or inability to use our website. We do not provide any warranty that the website or Sites which are linked to our Site are free from computer viruses or any other malicious or impairing computer program. The pages contained in the Site may contain technical inaccuracies and typographical errors. The information in these pages may be updated from time to time and may at times be out of date. We do not accept any responsibility for keeping the information in these pages up to date.
     
  6. Third party goods and services - We do not vouch for those persons, companies and other organisations whose goods or services may be accessed or displayed through or on the site. We take no responsibility for bad experiences or bad food at any of the restaurants. We do not have and never intend to have any contractual involvement in your bookings or other dealings with the restaurants on our site. We will not become involved in any dispute between You and any restaurant.
     
  7. Failure to enforce or non-reliance on any of these Terms and Conditions by Ourselves on a particular occasion or occasions will not prevent Us from subsequently relying on or enforcing them.
     
  8. All of Our offers may only be obtained by using a valid membership card, the expiry date of which will vary and thus will always be checked at each restaurant. To avoid embarrassment please do not attempt to use expired cards. Our card is strictly non-transferable and can only be used by named members and dining partner/s. Attempted misuse will result in confiscation. Restaurants may ask for a second form of ID.
     
  9. Grand Dining Club promotions and offers cannot be used in conjunction with any other offers or special offers.
     
  10. Grand Dining Club will not pay for losses arising from our inability to provide the services in the event of war, terrorism, invasion, an act of foreign enemy, hostilities (whether war be declared or not), riot, strike, civil commotion, civil war, revolution, insurrection or military or usurped power or for any reason that is beyond Our reasonable control.
     
  11. The service can be used once Your Grand Dining Club membership application has been processed and a membership card has been received by you.
     
  12. You can search for restaurants and view the exclusive GDC dining promotions online via the dedicated GDC website at www.grand-dining.co.za
     
  13. Restaurants offer 2 meals for the price of 1 or other exclusive members only discounts . Please check the details for the individual restaurant for specific details of the offer, including when the offer is available, how many courses the discount applies to and how many membership cards can be used per dining party.
     
  14. Please check availability of the Grand Dining Club offer on Public Holidays, Valentine’s Day, New Year’s Eve, the Christmas period and any other special days as these are often excluded.
     
  15. Some restaurants require You to book in advance by telephone using the telephone number displayed on their page of the website. When You telephone the restaurant You must state that You are a Grand Dining Club member.
     
  16. When You arrive at the restaurant You can order whatever food you want from the normal à la carte menu.
     
  17. You will only have to pay the relevant restaurant after you have eaten.
     
  18. Your membership card must be presented on arrival and when requesting the bill to receive the discount.
     
  19. Present Your membership card to the waiter at the end of Your meal and Your bill will be presented to You, minus your Grand Dining Club discount.
     
  20. If appropriate the waiter will restrict the number of times You can use your card by crossing off the restaurants number on the reverse of Your membership card.
     
  21. E-Commerce & Privacy. The Website www.grand-dining.co.za sells membership to the Grand Dining Club online. The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website. The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product. Credit card details are not kept by the Provider under any circumstances. The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device. The Provider will supply all goods to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.
     
  22. Online Payment – MyGate Payment Gateway. All online credit card payments are processed by the MyGate Internet Payment Gateway. Card Holders may go to www.mygate.co.za to view MyGate security policy.
     
  23. Refund and Return Policy. The provision of goods and services is subject to availability. In cases of unavailability, the provider will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10% charge for administration costs. The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions. Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to the Director at PO BOX 26433, Hout Bay, 7872, or info@grand-dining.co.za.
     
  24. Privacy: casual surfing. The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.
     
  25. Updating of these Terms and Conditions. Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s and Members obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s and Members continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
     
  26. Copyright and Intellectual Property Rights. Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). All such proprietary works, and the compilation of the proprietary works, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (“the Owners”), and is protected by South African and international copyright laws. The Providers reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the User and/or Member is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.
     
Choice of Law
Unless GDC agree otherwise:

A. the language of your agreement and all communications relating to it will be English; and
B. all aspects of your agreement, including negotiation and performance, is subject to South African law and the decisions of South African courts.
 
This Website is controlled, operated and administered by Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. The User may not use this Website in violation of South African export laws and regulations. If the User accesses this Website from locations outside of South Africa, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute.

If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Content and this Website.
